BİZBİZE USER AGREEMENT

ARTICLE 1. PARTIES:

BUYER/CUSTOMER: They are real or legal persons who place an order/supply of products on the website of the products for sale specified in this article.

BİZBİZE USER AGREEMENT

The subject of this contract is to determine the mutual rights and obligations of the parties in relation to the sale and use of the "BizBize" application, with the sales price specified on the website of the "BizBize" application, which the customer has placed electronically on the website of bizbize.live.

When ordering electronically from the bizbize.live website, you are entering into a binding contract with BİTES when you access all related features and functionality, websites and user interfaces, as well as all content and software applications associated with our services.

ARTICLE 3. SERVICE DESCRIPTION

Goods and services are subject to this contract; It is all kinds of sales and commercial activities carried out by BİTES through bizbize.live Video Conferencing Software services provided by BİTES on the website bizbize.live.

By purchasing the services, you accept that you have read and understood these agreements and that the terms outlined in this Agreement are binding on the parties. If you do not accept the Agreement, you may not use the BizBize Service or access any program-related content.

ARTICLE 4. BİZBİZE TERMS OF USE

4.1 SERVICE OPTIONS

A description of our service options and payment terms is available in the Payment Plan tab on the https://bizbize.live website.

ARTICLE 5. PAYMENT, THE RIGHT OF CANCELLATION AND WITHDRAWAL

5.1 BILLING

The quality, type of service and the sales price including all taxes are as stated in this Agreement and in the information on the service introduction page on the bizbize.live website.

5.2 PAYMENT PLAN

The credit card payment date is determined by the terms of the contract between the bank and the Buyer. The Buyer can also track their payments from the bank statement sent by the bank.

BizBize monthly prepaid usage fee or term fee may be changed by the Seller from time to time; in case of price change, this situation is notified to the Customer. In case of price changes, it will take effect from the beginning of the next subscription period following the price change date.

If the Customer continues to use the BizBize Service after the usage fee change takes effect, the Customer accepts the new price. If the Customer does not accept the price change, he has the right to reject the change by leaving the Paid Subscription before the price change takes effect.

In case of signing up for a Paid Subscription, the Customer may change his mind for any reason or no reason and demand a full refund of all monies paid within (14) fourteen days from the day (Withdrawal Period) he became a member for the relevant service, in accordance with the following conditions.

  • By signing up for a Trial, the Customer agrees that the Withdrawal Period for the Paid Subscription for which it has received a Trial will expire fourteen (14) days after the Trial starts. Paid Subscription cannot be cancelled before the trial ends. In such a case, the Customer loses his right of withdrawal and the agreed amount will be automatically charged to the Customer each month until BizBize Paid Subscription cancels.
  • If a Paid Subscription without a trial is purchased by the Customer, BizBize authorizes the Seller to automatically charge himself/herself each month until the Customer cancels. Customer; it is deemed that the Withdrawal Period is valid for fourteen (14) days after the purchase date, but if the BizBize Service is used within this period, the right of withdrawal shall be lost.

5.3 RENEWAL AND CANCELLATION

Unless the Paid Subscription has been purchased for a Prepaid Term, the paid subscription is automatically renewed at the end of the current subscription period, unless the paid Subscription is cancelled before the end of the current subscription period.

Cancellation takes effect the day after the last day of the current subscription period.

In case the paid subscription content is changed, the new paid subscription fee is collected from the Customer and the subscription is started from the date of the change, the remaining part of the previous paid subscription price is returned to the Customer.

Paid Subscription,

(1) After the Withdrawal Period ends;

(2) If the Customer cancels its payment or Paid Subscription and/or terminates any Agreement before the end of the subscription period, the subscription fee already paid will not be refunded.

The Customer should contact Customer Support if a refund is requested for payment made before the end of the Withdrawal Period. If any refund is processed by the Seller, the amounts will be refunded using the method used by the Customer for the payment.

ARTICLE 6. PRINCIPLES OF USE OF THE SERVICE

Within the scope of this Agreement, access and user permission will be granted for the Customer to use the BizBize Service.

This Access and Use Permission will remain in effect until the Agreement is terminated by the Customer or the Seller and/or bizbize.live.

The structure, arrangement and codes in the licensed software of BizBize Service and Content are the trade secrets of the Seller. Transfer, lease, copying, distribution, transfer and/or use of this software or its documentation in whole or in part, except as permitted by this agreement, illegal use and copyright infringement according to Laws of the Republic of Turkey. In case of use, transfer, rental, copying, distribution, transfer of all or a part of this software or documentation without the consent of the Seller, the legal responsibility of the interests will arise.

Except for the rights expressly granted in the agreement, this agreement does not grant the Customer any right, title or other interest in the Service or Content to Use.

ARTICLE 7. RIGHTS AND OBLIGATIONS OF THE PARTIES

7.1 The User hereby consents to the receipt of the information electronic messages of the Seller, who is the seller party of this contract, regarding all kinds of advertisements, promotions and all kinds of campaigns that he/she has made and/or will make in the future. If the customer does not want advertisements, promotional campaigns and messages to be sent to him, he must notify the Seller in writing. The Seller records, collects, stores and preserves your personal data obtained under this agreement as a data controller, limited and measured, in connection with the purposes of the establishment of this agreement and the execution of the activities in accordance with the Law Nr.6698. 7.2 User/Customer does not have the right to copy, redistribute, reproduce, "disassemble", save, transmit, publicly display, publish or make any part of the BizBize Service or the Content available to the public. In addition, the User/Customer may not use the BizBize Service or the Content in any way that is not expressly permitted in Agreements or applicable law or that otherwise violates any intellectual property rights (such as copyright) in the BizBize Service or Content or any portion thereof. In case of violation of this article, this user agreement will be terminated and the Seller reserves the right to demand compensation for the damages incurred.

7.3 Confidentiality and security of the account and password are the responsibility of the customer/the user. The Seller does not have any responsibility if the user name or password is lost or stolen, or in case of unauthorized access to the customer's account by a third party; the situation must be reported to the customer service by immediately communicating with the Seller.

7.4 The Seller will use reasonable efforts to ensure that the BizBize Service continues to function properly. However, certain technical difficulties, maintenance or testing, or updates required to reflect changes in applicable laws and regulatory requirements may occasionally result in temporary outages. The actual interruption, change or termination of the BizBize Service or any of its functions or features, the need to repair, maintain or improve existing functions or features, or the need to add new functions or features to the Service, advances in science and technology to ensure the operability or security of the Service. We reserve the right to change or remove the functions and features of the BizBize Service regularly and at any time, temporarily or permanently, with prior notice where possible, without any obligation to the customer, except for valid reasons such as practice, legal and regulatory reasons, except where permitted by law.

ARTICLE 8. TECHNICAL SUPPORT / CUSTOMER SUPPORT

For customer support regarding BizBize account or payment-related questions ("Customer Support Inquiries") by the Customer, the Customer Service department shall be contacted by using support@bizbize.com.

ARTICLE 9. AGREEMENT TERM AND TERMINATION

9.1 The Agreements will continue to be valid until the User is terminated by the customer or the Seller. This agreement may be terminated by the customer or the Seller at any time.

9.2 Seller may terminate the Agreements or provide access to the BizBize Service at any time in the event of actual or suspected unauthorized use of the BizBize Service and/or Content, non-compliance with the Agreement, or the removal of the Services and/or Content by the Seller (in which case the Seller will provide reasonable notice to the customer prior to doing so) suspend the customer's access.

9.3 The Seller shall not be liable if the Agreements are terminated by the seller or by the customer, or if customer access to the BizBize Service is suspended. Fees paid by the customer up to that time are non-refundable.

9.4 If the Customer wishes to learn how to terminate the BizBize user account, he may contact the Seller via the Seller contact information available on the About Us page of the Seller's website.

ARTICLE 10. SEVERABILITY

If any provision of this agreement is for any reason or to any extent invalid or unenforceable, the remaining provisions of the agreements will remain in effect.

ARTICLE 11. DISPUTES

In disputes that may arise regarding this agreement, Ankara Courts and enforcement offices are authorized.

ARTICLE 12. NOTICES AND EVIDENTIAL CONTRACT

Any correspondence to be made between the Parties under this Agreement will be made via e-mail, except for the obligatory cases listed in the legislation. The Customer agrees that in disputes that may arise from this Agreement, the Seller's official books and commercial records, electronic information and computer records kept in its database, servers, will constitute binding, final and exclusive evidence and that this article will constitute an evidential contract within the meaning of Article 193 of the Code of Civil Procedure. The Customer accepts, declares and undertakes that it is an evidentiary contract within the meaning of its article.

ARTICLE 13. CURRENCY

When the customer makes the payment for the order placed on the BizBize Web Site, he/she is deemed to have accepted all the terms of this agreement.

The seller is obliged to make the necessary software arrangements to obtain confirmation that this agreement has been read and accepted by the customer on the site before the order is fulfilled.
